1. The provider and contractual partner, the contractual language

The provider and contractual partner for your order is:

You have the ability to order and purchase agreement in German or English language.

The full contract text is not stored with the provider. Before sending an order through the online shopping basket system, the contract data can be printed by using the print function of the browser or can be saved electronically. After receipt of the order, the supplier will sent the order data, the information required for distance contracts (cancellation terms) and the terms and conditions to the customer by email.

2. Conclusion of the contract

2.1 The product representations on the Internet are not binding and no binding offer to conclude a contract.

2.2 The customer may purchase a binding offer (order) online by using the shopping-basket-system. At this process, the goods are stored in the "basket". On the appropriate button in the navigation bar, customers can select the "basket" and then make changes at any time. After selecting the button "Check out" and the input of personal data, terms of payment and shipping terms, all data are shown on the order summary page. Before submitting the order, the customer has the opportunity here to check all the details again to change (via the "back" of the Internet browser) or to cancel the purchase. By sending the order by clicking the button "Buy it" the customer makes a binding offer to the provider. The customer receives an automaticlly generated email of the receipt of his order, which does not lead to the conclusion of the contract.

2.3 The acceptance of the offer (and therefore the contract) is done either by confirmation in writing (by email), in which the order processing or delivery of goods is confirmed, or by delivering the goods. If the customer should have not received a confirmation or notice within 5 days, he is no longer bound by his order. In this case, payments already done, will be refunded immediately.

2.4 The process of ordering and forwarding of all in connection with the contract required informations are made by email (partially automated). The customer must ensure, therefore, that the provider of his e-mail address is stored correctly, will ensure the receipt of emails and especially not technically prevent SPAM filters.

3. Shipping

If it`s possible you will receive the goods in only one delivery, unless your order contains articles which have to be packed or dispatched seperately oor articles that be disposable at a later date. There will be no disadvantages for you because "La Purpura de la Rosa" will take over the additional forwarding charges.

The availability and delivery time are indicated for each product in the shop. The delivery time is valid for shipments within Germany. If you pay in advance, the delivery can move, because the ordered goods will be shipped only after payment is received.

We deliver to customers all over the world. If an article is not available we will note this on the invoice or will inform you in advance by email or by phone.

Damages for late delivery or non-availability is excluded, unless there is gross negligence on our part.

4. Reservation of proprietary rights

Till completely payment the property in goods remains on La Purpura de la Rosa | Inh. Petra Woertche-Borucinski.

5. Warranty

For all goods from our shop the legal warranty rights are valid.

6. Liability

"La Purpura de la Rosa" is only liable for damages based on intent or gross negligence. In the cause of violation of contract "La Purpura de la Rosa" is liable for any culpable conduction of its employees. "La Purpura de la Rosa" is not liable for indirect damages - particularly not for missed profits, unless when the damages are founded on intension of employees or on intention and gross negligence of representatives or executives from "La Purpura de la Rosa". Unless the intent of staff and willful intent and gross negligence of legal representatives and officers the liability is limited to the amount of the damages typically foreseeable upon conclusion of contract. "La Purpura de la Rosa" assumes no liability for the constant and uninterrupted availability of lapurpura.com and for technical or electronic errors of the third party in the Internet network.

7. Additional

This conditions for using are defeated to the german law with exclusion of the UN-law of trading, also if the order comes from foreign countries or the parcel adress is in foreign countries. The right to depreciation or increase exists only if the claims are final stipulated or if they are accepted in writing. The right to keep back exists only as long as the claims are founded on the same contract.
